Terms of service

1. The service

Tampu, by NEKATEKLABS S.A.S. (RUC 1999320380001, Zamora, Ecuador), is a web management platform for inns: bookings and calendar, front desk, rooms and housekeeping, the guest bill, SRI electronic invoicing, reports, and modules for restaurant, pool, parking, event halls and nightclub. The modules each business uses are agreed when it signs up.

2. The client business’s responsibilities

• Entering accurate and current information: rooms, rates, taxes, availability and its company details.
• Keeping its staff accounts secure and giving each person only the roles they need.
• Informing its guests and customers about how their data is processed and handling their requests. For that data, the business is the controller and Nekatek Labs is the processor.
• Complying with the rules that apply to it as a lodging establishment, including guest registration rules.

3. Electronic invoicing

Tampu builds electronic invoices, signs them with the business’s electronic signature and sends them to the SRI. Authorization of each document depends on the SRI. The business is responsible for having its RUC, a valid electronic signature and its tax settings correct, for reviewing its documents and for its tax returns. Tampu is a tool and does not replace accounting advice.

4. Plans, prices and payment

The service is paid as a monthly fee based on the modules and the size of the inn, agreed in writing with the business. Prices exclude VAT (IVA), which is added. Set-up may have a one-time cost. There is no minimum term: either party can end the service with 30 days’ notice.

5. Acceptable use

Tampu may not be used for illegal activity, to try to access other businesses’ data, to overload the service or to send unsolicited messages. We may suspend the service if these terms are breached.

6. Availability

We work to keep the service available at all times, but there may be interruptions for maintenance or because of third-party failures, such as Google Cloud or the SRI system. We will tell you about planned maintenance where possible.

7. Data and ownership

The data a business enters into Tampu remains its own. It can export its reports to CSV. When the service ends, we will agree on delivering and deleting its data, except what the law requires us to keep. Processing of personal data is governed by our Privacy policy.

8. Liability

We provide the service with the reasonable care of a software provider. We are not liable for penalties, fines or losses arising from incorrect data, rates, taxes or settings entered by the business, or from interruptions of third-party services. Our total liability to a business is limited to what it paid for the service in the 12 months before the claim.

9. Changes

We may update these terms; we will announce important changes with reasonable notice. If you keep using the service after the effective date, you accept the new version.
